General Terms and Conditions (GTC) of DARKNUDE Menswear

1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders placed by consumers (Section 13 of the German Civil Code [BGB]) and entrepreneurs (Section 14 BGB) via the DARKNUDE online shop.

Deviating terms and conditions of the customer are not recognized unless we expressly agree to their validity in writing.

2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By submitting the order via the “Order with obligation to pay” button, the customer makes a binding offer to conclude a purchase contract.
Upon receipt of the order, the customer receives an automatic order confirmation via e-mail. This confirmation does not yet constitute acceptance of the offer.
The purchase contract is concluded only upon shipment of the goods or through an express order confirmation.

3. Prices and Shipping Costs
All prices stated are in Euros (€) and include statutory VAT, where applicable.
Additional shipping costs are displayed to the customer during the order process (in the shopping cart and at checkout) as well as on the “Shipping Information” page.
For deliveries outside the European Union, import duties, taxes, or customs fees may arise and must be borne by the customer.

4. Terms of Payment
The payment methods offered during the order process are available to the customer.
Payment is due immediately after the conclusion of the contract.
If an external payment method is selected, the terms and conditions of the respective payment service provider also apply.

5. Delivery
Delivery is made to the delivery address specified by the customer. Unless otherwise agreed, the delivery time is:
* Germany: 2–5 business days
* European Union: 3–10 business days
* Outside the European Union: No shipping currently available. Please feel free to inquire via email.

Should an item be unavailable or delivery delayed, the customer will be informed immediately.

6. Retention of Title
The delivered goods remain our property until full payment has been made.

7. Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal.
Details can be found in the separate instructions on the right of withdrawal.

8. Returns
To exercise the right of withdrawal, the goods must be returned within the statutory period of 14 days.
You must notify us of your return via email before shipping it back. We reserve the right to refuse acceptance of returns that have not been notified in advance. You bear the cost of the return shipment.
For a full refund, the goods should be returned:

* unworn,
* unwashed,
* free from signs of use,
* with original tags attached, and
* preferably in the original packaging.

This does not affect your right to inspect the goods as would be possible in a retail store.

9. Warranty
Statutory liability rights for defects apply.

10. Liability
We are liable without limitation in cases of willful misconduct and gross negligence.
In the event of a slightly negligent breach of essential contractual obligations, we are liable only for foreseeable damage typical of the contract.
These limitations of liability do not apply to damages resulting from injury to life, body, or health, or under the Product Liability Act.

11. Vouchers
Promotional vouchers can only be redeemed within the specified validity period. Cash payment or retroactive offsetting is excluded.
Gift vouchers may be used until fully redeemed.

12. Product Presentation
Products are presented with the utmost care.
Color variations due to differences in monitors, displays, or mobile devices are technical in nature and do not constitute a defect.

13. Copyright
All content in the online shop—including, in particular, logos, photographs, product images, graphics, text, designs, and other content—is protected by copyright.
Any use beyond the statutory limits of copyright law requires our prior written consent.

14. Data Protection
Information regarding the processing of personal data can be found in our privacy policy.

15. Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Sales Convention (CISG).
Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, in whole or in part, the validity of the remaining provisions shall remain unaffected.
